Thank you for your interest in LEGIT-E-BIKES. These Consumer Purchase Terms and Conditions (the “Terms”) form a legally binding agreement between you (“you” or “Customer”) and LEGIT-E-BIKES for all purchases you make of LEGIT-E-BIKES and any related accessories or other products (collectively, the “Products”) in the United States. By purchasing and/of using the Products, you agree to these Terms in full. You also confirm that you are at least 17 years old or have reached the age of legal majority in your jurisdiction, whichever is higher. If you do not meet this minimum age requirement, you are not permitted to purchase Products from LEGIT EBIKES.

PLEASE READ THESE TERMS CAREFULLY, AS THEY INCLUDE AN AGREEMENT TO ARBITRATE DISPUTES (RATHER THAN HAVING A JURY TRIAL OR CLASS ACTION) AND REQUIRE YOU TO WAIVE CERTAIN RIGHTS.

1. Application

a. These Terms apply to any purchase of Products from LEGIT-E-BIKES and any subsequent use of your LEGIT-E-BIKE.
b. Other agreements may also apply to your relationship with LEGIT-E-BIKES, including:

  • Terms of Use
  • Privacy Notice
  • Owner’s Manual

You can find copies of these Terms and all related documents on our website.

2. Classification of Bikes

Recent regulations in many states and local jurisdictions have tightened definitions of what qualifies as an “e-bike.” Because our LEGIT-E-BIKES can be unlocked above 750W, some jurisdictions might not recognize them as traditional e-bikes. Certain jurisdictions allow these bikes to remain in Class 1, Class 2, or Class 3 if kept at or below 750W, but others do not. It is your responsibility to understand and follow all applicable laws in any area you plan to operate your LEGIT-E-BIKE. Some places may prohibit LEGIT-E-BIKES on public roads. Know and follow all local laws before making your purchase

3. Online Orders

a. Placing an order for a LEGIT-E-BIKE is considered an offer to buy. Once you submit your order, we will confirm receipt via email. However, your order is only officially accepted once we ship the product.
b. We reserve the right to cancel or limit quantities of any order at any time, even after confirmation, if we believe there is an error or suspected fraud.
c. Special offers, codes, or referral promotions cannot be combined. We may change or end these promotions at any time at our sole discretion.

4. Shipping

a. Contiguous United States: Shipping for LEGIT-E-BIKES within the contiguous US is a flat rate of $275. Palletized freight orders may have additional fees, clearly indicated at checkout.
b. Alaska and Hawaii: We can arrange shipping to select areas in Alaska and Hawaii; please contact us at 3038191348 for quotes.
c. No shipments go to Puerto Rico, other US territories, P.O. boxes, or APO/FPO addresses.
d. International Shipments:

  • We do not ship internationally.
  • If you arrange international shipping on your own, you are responsible for all duties and taxes.
  • We will not provide service or warranty for bikes shipped overseas.
  • If replacement parts are needed, you must pay all associated shipping, parts costs, and import fees.

e. Shipping Confirmation: You will receive an email with tracking information once your order ships.
f. We typically ship via FedEx or other parcel service, though we do not ship to P.O. boxes or APO addresses.
g. Orders with discounted items may require an extra 48 hours to process.
h. An order cannot be changed or canceled once a shipping label is created.
i. We are not responsible for any loss, damage, or theft caused by the shipping carrier.
j. You are responsible for round-trip shipping costs if you return an item, and these costs are non-refundable.
k. We recommend using a trackable shipping service and buying shipping insurance; we cannot guarantee receipt of returns.
l. Products designated as “in stock” usually ship in 2–5 business days (unless you have a pre-order).
m. Pre-ordered items have estimated shipping dates listed next to the “Pre-Order” button.
n. If a LEGIT-E-BIKE battery ships separately, you will receive a separate tracking number.
o. Occasionally, there may be delays between our email confirmation and the carrier’s package scan. Tracking information may not be accurate until the carrier scans the package.
p. Refusals: If you refuse delivery, it will be treated as a return, and round-trip shipping costs will be deducted from your refund.
q. It is your responsibility to follow the rules and regulations regarding LEGIT-E-BIKES in your locality.

5. Terms For Purchases

a. Transfer of Ownership

  • Ownership (title) and risk of loss of the Products pass to you once LEGIT-E-BIKES transfers the Products to the carrier.
  • If we haven’t received full payment before shipping, we retain ownership until paid in full.
  • We may terminate your right to use the Products if payment is declined or reversed for any reason.

b. Updates to Bike Parts

  • We may update any part or component of our bikes, or change suppliers, without notice. Any such change does not grant grounds for returning your product.

c. Battery and Range

  • Actual range depends on many factors (e.g., battery age, temperature, speed, terrain, payload). Any range figures we provide are estimates, not guarantees.

d. Alterations

  • Any changes you make to a LEGIT-E-BIKE that affect its safety, mechanics, or operation may void the warranty and are made at your own risk.

6. Ownership

a. Title and risk of loss pass to you once we hand the Products to the shipping carrier. If we haven’t received full payment, we still own the Products until payment is complete. We may terminate your use of the Products if payment is not made on time or if the card issuer requires repayment for any reason.
b. If your payment is declined, reversed, or otherwise unpaid, we retain full ownership. We reserve all rights, where allowed by law, to end your rights to use the Products until payment is resolved.
 

7. Cancellations (5% Processing Fee Will Apply on all Cancellations)

a. Cancelling In-Stock Bikes
•    If you placed an order for an in-stock LEGIT-E-BIKE, you can cancel before a shipping label is generated (manually or automatically).
•    All cancellations are subject to the fees described below.
•    Once a shipping label is created, we cannot cancel your order. If desired, see our Return Policy in Section 12.
b. Cancelling Pre-Ordered Bikes
•    If you ordered a bike on “Pre-Order,” you may cancel if:
1.    Fewer than 10 days have passed since your purchase, AND
2.    No shipping label has been generated yet.
•    If more than 10 days have passed or a shipping label has already been created, we cannot cancel your order. See Section 12 for return instructions.
•    Pre-orders are used to determine how many bikes of each model/color get manufactured and shipped. Cancelling affects our logistics and other customers, so all cancellations meeting the above conditions are subject to the fees below.
c. How to Cancel
•    You must call us at 3038191348 during telephone business hours to request a cancellation. We will not accept cancellation requests by other means.
•    Our Customer Service team may ask you to confirm your cancellation via email.
d. Card Processing Fee
•    If we have already captured your credit/debit card, Shop Pay, Shop Pay Installments, PayPal or any other means of payment method, we retain 5% of the total refund to cover non-recoverable transaction fees and other costs involved. This may seem unfair, however, it costs us money every time someone places an order and then cancels. This is actual money we are losing every time it occurs. 
 

8. LEGIT-E-BIKES Performance

Information about the expected battery range of our LEGIT-E-BIKES (on a single charge) is an estimate rather than a guarantee. Range can vary significantly based on temperature, terrain, battery age, speed, payload, and other conditions.

We reserve the right to use equivalent-quality or better substitute parts or equipment that meet our standards.

Any modifications you make to a LEGIT-E-BIKE that could affect safety or mechanics may void the Limited Warranty. LEGIT-E-BIKES is not liable for any injuries or damages resulting from your alterations.

9. LEGIT-E-BIKES Safety and Waiver of Liability

Important: Read Carefully
Failure to follow these Terms means you assume all liability for any injury or property damage resulting from using our LEGIT-E-BIKE, and you waive any related claims to the fullest extent allowed by law.

a. Age Requirement: No one under 17 should operate a LEGIT-E-BIKE. Operating these bikes requires judgment and skill.
b. If a Minor Operates the Bike: A minor and their parent/guardian assume all risks and waive any claims for damage or injury.
c. Helmets and Safety Gear: Always wear a properly fitted helmet covering your forehead. Check and comply with local laws for required safety gear.
d. Pre-Ride Checks: Vibration and normal wear can loosen components. You must inspect your LEGIT-E-BIKE before each ride, following the owner’s manual.
e. Risk of Injury: Operating any bike can result in serious injury or death. You fully assume these risks.
f. Assembly and Maintenance: Improper assembly or maintenance can cause accidents or malfunction. Read your entire owner’s manual and all included instructions before riding.
g. Battery and Charger Safety: Do not use damaged batteries or chargers. Stop using them immediately if you notice frayed cords, unusual odors, overheating, or damage from impact or water. Follow local rules to dispose of defective batteries properly.
h. Waiver and Release: To the fullest extent allowed by law, you release LEGIT-E-BIKES from any claims or demands for injuries, death, or damage to property arising from the use of a LEGIT-E-BIKE, including claims based on negligence or defects in design/manufacture.

10. Pre-Orders and Backorders

a. Your card will be charged immediately when placing a pre-order or backorder.
b. Any cancellations follow the policy 

11. Payments

a. Our online store uses Shopify’s payment portal. Payments may be declined for any reason at LEGIT-E-BIKES discretion.
b. If we accept a pre-order, your payment method is charged upon our approval, not necessarily when the item ships.
c. A chargeback on any portion of your order pauses your Limited Warranty until the issue is resolved.
d. Tax: All required taxes (including sales tax) will be collected at checkout.

 

 

12. Return Policy and Restocking Fees

a. Returns, Refunds, and Restocking Fees

  • Returning New Bikes:
    • You may return a new Legit-E-bike within 14 days of receipt, provided it is unused, in new condition, and in original packaging.
    • You are responsible for round-trip shipping costs, which will be deducted from your refund.
    • We do not charge a restocking fee for new bikes, but any shipping damage will also be deducted from the refund.
    • Contact us first to arrange the return and discuss shipping.
  • Returning Used Bikes:
    • We currently are not returning used bikes.
  • Battery Returns: Battery purchases are non-returnable due to shipping restrictions for high-capacity lithium-ion batteries.
  • Return Shipping Costs: You are responsible for all shipping charges related to returning any item. These costs are non-refundable.

b. Return to Sender or Refused Shipment

  •  Liability

Our liability to you for any damage or injury is limited to the price you paid for the Products that gave rise to the claim. We are not liable for any other damages or losses, except for those required under the law (e.g., in cases of gross negligence or fraud).

We strongly recommend you review your insurance coverage and the waiver of subrogation in Section 17, which is a material part of these Terms.

14. Disclaimer of Implied Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR PRODUCTS ARE PROVIDED “AS IS,” WITH NO WARRANTIES BEYOND THE EXPRESS LIMITED WARRANTY THAT ACCOMPANIES YOUR PRODUCT. WE DISCLAIM ALL OTHER WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

15. Disclaimer of Certain Damages

TO THE MAXIMUM EXTENT ALLOWED BY LAW, NEITHER LEGIT EBIKES NOR OUR AFFILIATES, SUPPLIERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, GOODWILL, DATA, OR BUSINESS INTERRUPTION RELATED TO THESE TERMS OR THE PRODUCTS.

16. Acknowledgment and Indemnification

You understand that riding and using LEGIT-E-BIKES carries potential risks of injury or harm. By using our Products, you acknowledge and accept all associated risks. You agree to defend, indemnify, and hold Legit-E-bikes and its representatives harmless from any claim or demand arising from your misuse or breach of these Terms, including legal fees. If Legit-E-bikes chooses to defend any such claim, you agree to cooperate fully with us.

17. Waiver of Subrogation

YOU AGREE THAT YOU OR YOUR INSURERS WILL NOT SEEK PAYMENT OR COMPENSATION FROM LEGIT-E-BIKES (“WAIVE ANY RIGHT OF SUBROGATION”) FOR ANY LOSSES OR INJURIES BEYOND THE LIABILITY LIMITS SET FORTH IN THESE TERMS. YOU MUST ENSURE YOUR INSURANCE POLICIES CONTAIN A PROVISION OR ENDORSEMENT WAIVING SUBROGATION RIGHTS AGAINST LEGIT-E-BIKES.

18. Dispute Resolution and Binding Arbitration

THIS SECTION AFFECTS YOUR RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

A. You and Legit-E-bikes  and any disputes by individual, binding arbitration, not by court.
B. This includes all claims, past or present, related in any way to your purchase or use of the Products.
C. You may still bring individual claims in small claims court if they qualify.
D. Legit-E-bikes will pay your arbitration fees.
E. Arbitration will be administered by the AAA under its Consumer Arbitration Rules.
F. The arbitrator has sole authority to decide if these Terms are valid and enforceable.
G. The arbitrator’s decision is final and can be entered in any court with jurisdiction.
H. Claims cannot be brought as a class action or joined with others.
I. All arbitration proceedings, including documents and awards, are confidential unless disclosure is required by law.
J. Arbitration is governed by the Federal Arbitration Act (FAA).

19. Notices and Updates

We may provide legal or other notices by posting them on our website or emailing the address associated with your account. If you change your contact details and do not update us, you may miss important notices.

20. Governing Law

These Terms and any disputes between you and Legit-E-bikes are governed by Colorado State law, without regard to conflict-of-law rules.

20. General

A. Section titles in these Terms are for reference only.
B. Legit-E-bikes  decision not to enforce a provision is not a waiver of future enforcement.
E. If any part of these Terms is deemed unenforceable, the remaining parts remain valid.
F. We can assign these Terms or our rights/obligations at any time without notice. You may not assign your rights.
G. These Terms (and any documents or policies referenced) constitute the entire agreement between you and Legit-E-bikes.
H. No other person or entity, besides you, Legit-E-bikes successors/assigns, has any rights under these Terms.
